Art Supply Enterprises, Inc., dba MacPherson’s, Settles For $125,390

In June 2023, the California Air Resources Board (CARB) reached a settlement with Art Supply Enterprises, Inc., dba MacPherson’s (MacPherson’s), with its principal location in Emeryville, California, for the company’s violation of CARB’s Aerosol Coating Products Regulation, as codified in the California Code of Regulations, title 17, section 94520 et seq.

An investigation conducted by CARB Enforcement staff revealed MacPherson’s sold, supplied, offered for sale and/or manufactured for use in California, aerosol coating products that exceeded the reactivity limits specified in the Aerosol Coating Products Regulation (Cal. Code Regs., tit. 17, § 94522(a)). In addition, MacPherson’s sold, supplied, offered for sale and/or manufactured for use in California, aerosol coating products that did not display the aerosol coating product category and applicable reactivity limit, and failed to submit an annual explanation of the code representing the date of manufacture, as required by the Aerosol Coating Products Regulation (Cal. Code Regs., tit. 17, § 94524). To settle the case, MacPherson’s agreed to a penalty of $125,390 for 9.63 tons of excess reactivity emissions, one day of violation for the category and limit labeling, and one day of violation for the date code.

The full penalty amount will be deposited into CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality. MacPherson’s fully cooperated with CARB to resolve this matter and has ceased sales of the noncompliant aerosol coating products in California.
