Walmart, Inc., through Sam’s West, Inc., dba Sam’s Club, a division of Walmart Settles For $41,400
In April 2023, the California Air Resources Board (CARB) reached a settlement with Walmart, Inc., through Sam’s West, Inc., dba Sam’s Club, a division of Walmart (herein, Walmart), with its principal location in Bentonville, Arkansas for violations related to CARB’s air quality regulations.
An investigation conducted by CARB staff showed that Sam’s Club sold a total of 138 non-California compliant pressure washers to California consumers. CARB documented the violations as they relate to the Evaporative Emissions Regulation (Cal. Code Regs., tit. 13 § 2751(a)). To settle the case, Walmart agreed to the penalty of $300 per violation for a settlement of $41,400.
The settlement amount will be deposited into CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality. Terms of the settlement include a corporate compliance plan that Walmart has now implemented. The compliance plan includes more frequent audits to comply with CARB regulations and to match these products with California Sam’s Clubs going forward. Through Walmart’s diligence and cooperation with CARB, the company has been brought into compliance.
