NuvoMed, Inc. Settles For $25,000
In October 2022, the California Air Resources Board (CARB) reached a settlement with NuvoMed, Inc. (NuvoMed), with its principal location in Downers Grove, Illinois, in the amount of $25,000 for the company’s violation of CARB’s air quality regulations.
An investigation conducted by CARB staff showed that NuvoMed violated the Regulation for Limiting Ozone Emissions from Indoor Air Cleaning Devices because they manufactured for use in California, sold, supplied, offered for sale, and introduced into commerce in California, indoor air cleaning devices that were not certified by CARB. Indoor air cleaners are subject to an ozone emission concentration limit of 0.050 parts per million (ppm) and are required to be certified prior to sale in California. Additionally, NuvoMed failed to include a statement excluding sales to California on webpages advertising uncertified indoor air cleaners, and NuvoMed did not inform distributors, sellers, and retailers of the Indoor Air Cleaner Regulation (Cal. Code Regs., tit. 17, § 94800 et seq.).
To come into compliance, NuvoMed issued a recall of uncertified indoor air cleaners offered for sale with a popular retailer in California. NuvoMed also received CARB certification for five models of indoor air cleaning devices and stopped sales of uncertified indoor air cleaners in California. NuvoMed fully cooperated with CARB toward resolution in this matter.
The penalties in this case were reduced because NuvoMed was able to demonstrate financial hardship. The $25,000 will be deposited into CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality.
