John Deere Case Settles for $6,000.00
In December 2012, the ARB reached a settlement with John Deere that included a $6,000 penalty to the California Air Pollution Control Fund for shipping mislabeled gator vehicles to California in violation of Title 13, California Code of Regulations and ARB’s Executive Order.
An investigation by ARB showed that between June 2011 and December 2011, John Deere shipped mislabeled gator vehicles to California. This was also documented in a self-disclosure letter submitted by John Deere. In the notification, John Deere admitted to have over two thousand (2,000) potentially mislabeled gator vehicles. However, during the investigation, ARB determined sixteen (16) mislabeled gator vehicles were shipped to California dealerships. John Deere initiated a re-labeling campaign which was approved by both the U.S. EPA and the ARB on May 11, 2012 and May 16, 2012 respectively. The outcome of the investigation revealed that John Deere’s actions violated Sections 43151 through 43153 of the H&SC and section 2413 of the California Code of Regulations. The case settled in December 2012, for six thousand dollars ($6,000).
