Jerry Melton & Sons Construction, Inc. Case Settles for $42,150.00

In June 2013, Jerry Melton & Sons Construction, Inc. agreed to pay $42,150.00 in penalties for violating air quality regulations: $31,612.50 will go to the California Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality; $10,537.50 will go to the Peralta Colleges Foundation to fund emission education classes conducted by participating California community colleges, under the California Council for Diesel Education and Technology program. 

An investigation by the Air Resources Board (ARB) showed that Jerry Melton & Sons Construction, Inc. failed to properly self-inspect their diesel trucks to assure the trucks met state smoke emission standards, failed to properly affix Emission Control Labels on the engines of their fleet vehicles, failed to meet PM BACT requirements for all 1996 through 1999 engine model years by January 1, 2012, and 2000 through 2004 model years by January 1, 2013 as required by the Truck and Bus Regulation, and failed to report and label off-road equipment prior to the August 1, 2009 deadline. ARB documented violations as they related to the Periodic Smoke Inspection Program (PSIP), the Emission Control Label (ECL) Program, the Truck & Bus Regulation, and the Off-Road Diesel Vehicle Regulation. To settle the case, Jerry Melton & Sons Construction, Inc. agreed to the $42,150.00 penalty and to comply with the Periodic Smoke Inspection Program, Emission Control Label Program, the Truck and Bus Regulation, the Off-Road Diesel Vehicle Regulation and other ARB programs.
