Furniture of America, Inc. Settles For $18,000
In June 2021, the California Air Resources Board and Furniture of America, Inc. (FOA), of Rowland Heights, California, reached a settlement agreement in the amount of $18,000. FOA sold, supplied, and offered for sale in California beds that contained noncompliant hardwood plywood bed slats. FOA did not take reasonable prudent precautions when purchasing the Elaine Bunk Bed from Tayu Wood (Vietnam) Co., Ltd. and the Hendrik Bed and Ivory Upholstered Bed, both from Dongguan Jing Sheng Industrial Co., Ltd. This is a requirement set forth in the Airborne Toxic Control Measure to Reduce Formaldehyde Emissions from Composite Wood Products, (ATCM). FOA did not put a statement of compliance on its customer invoices or bills of lading, and did not have a complete label on the Ivory Upholstered Bed, which are both required by the ATCM. To come into compliance, FOA has implemented a compliance plan that includes testing ten random products every six months.
