ESW Canada, Inc. Case Settles for $9,329.50
In November 2012, ESW Canada Inc. agreed to pay $9,329.50 in penalties for violating air quality regulations: $6,997.12 will go to the California Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality; $2,332.38 will go to Peralta Community College District to fund emission education classes conducted by participating California community colleges, under the California Council for Diesel Education and Technology (CCDET) program. This settlement was reached in December 13, 2011.
An investigation by the Air Resources Board (ARB) showed that ESW Canada Inc. failed to comply with the Verification Procedure, with respect to offering for sale and selling in California, between 2009 and 2010, ThermaCat Diesel Particulate filters used in off-road applications that did not conform to the conditions specified in the filter’s applicable executive orders. To settle the case, ESW Canada Inc. agreed to the $9,329.50 penalty and to comply with the Verification Procedure.
