Danmoto Motorcycle Accessories, LLC. Case Settles for $6,800.00
Danmoto Motorcycle Accessories, LLC. (Danmoto) sold, offered for sale, and/or advertised, in California, aftermarket critical emission control parts for motorcycles. These parts were intended for use with, or as a part of, a required motor vehicle pollution control device or system and alters or modifies the original design or performance of that motor vehicle pollution control device or system. However, the parts were not issued ARB Executive Orders that exempt them from California’s anti-tampering laws. The Executive Orders ensure that the aftermarket critical emission control parts comply with the applicable aftermarket part regulations, and thus do not reduce the effectiveness of any vehicle pollution control system or cause the vehicle emissions to exceed applicable emission standards.
This case was settled in May 2013 with Danmoto agreeing to pay $6,800 to the California Air Pollution Control Fund and implement a safety plan to prevent future violations. ARB enforcement staff continues to monitor eBay for sellers who sell uncertified aftermarket parts and will take enforcement action accordingly.
