Bernadini Enterprises, Inc. Case Settles for $7,875
In March 2015, Bernardini Enterprises, Inc. paid $7,875 for non-compliance with Air Resources Board regulations: $1,969 went to the Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality; $656 went to the Peralta Colleges Foundation to fund emission education classes conducted by participating California community colleges, under the California Council for Diesel Education and Technology (CCDET) program; and the return of Carl Moyer Memorial Air Quality Attainment Standards Program (Carl Moyer) funds of $5,250 goes to the Bay Area Air Quality Management District for non-compliance with ARB regulations as required by the Carl Moyer contract.
An investigation by the Air Resources Board (ARB) showed that Bernardini Enterprises, Inc. failed to properly self-inspect their diesel trucks to assure the trucks met state smoke emission standards. ARB documented violations as they related to the Periodic Smoke Inspection Program (PSIP). To settle the case, Bernardini Enterprises, Inc. agreed to the $2,625 penalty, the $5,250 return of Carl Moyer funds, and to comply with the PSIP and other ARB programs.
