Bay Area Asphalt and Cement Works, Inc. Case Settles for $52,000
Bay Area Asphalt and Cement Works, Inc., will pay $52,000.00 in penalties for violating air quality regulations: $13,000.00 to be paid to the Peralta Colleges Foundation for education classes conducted by participating California community colleges, under the California Council for Diesel Education and Technology Program; and $39,000.00 to the Air Pollution Control Fund for research and projects directed at improving California's air quality. This settlement was reached in September 2015.
An investigation by the Air Resources Board (ARB) showed that Bay Area Asphalt and Cement Works, Inc., failed to bring 4 of their heavy duty diesel vehicles into compliance with the applicable in-use performance standards and failed to properly self-inspect their diesel trucks to assure the trucks met state smoke emission standards. ARB documented violations as they related to the Periodic Smoke Inspection Program, and Truck and Bus Regulation. To settle the case, Bay Area Asphalt and Cement Works, Inc., agreed to the $52,000.00 penalty and to comply with Periodic Smoke inspection Program, Truck and Bus Regulation, and other ARB programs.
