Aprilia Sherman Oaks Case Settles for $15,700

In October 2011, the Air Resources Board (ARB) reached a settlement with David Meyer, doing business as Aprilia Sherman Oaks and Aprilia Thousand Oaks that included a $15,700 penalty to the California Air Pollution Fund for offering for sale and selling twelve new Aprilia motorcycles that were not certified for sale or use in California. An investigation by the ARB showed that Aprilia Thousand Oaks, which is no longer under the same ownership, modified eleven new CA certified motorcycles by removing emissions control equipment as part of a high performance package and ultimately sold and registered them to California residents. Aprilia Sherman Oaks offered for sale one new 2010 Aprilia motorcycle that had not been certified by ARB. These motorcycles were illegal for sale or use in California and were in violation of Health and Safety Code sections 43151 through 43153. The case settled in October 2011 for Sixty Thousand Dollars ($60,000) with Forty Four Thousand Three Hundred Dollars ($44,300) being stayed as long as the conditions of the Settlement are met.
