Tristar Products, Inc. and Trend Makers, LLC Settles For $98,000
In August 2024, the California Air Resources Board (CARB) reached a settlement with Tristar Products, Inc. (Tristar), with its principal location in Santa Rosa Beach, Florida, and Trend Makers, LLC (Trend Makers), with its principle location in Fort Walton Beach, Florida for the Tristar’s violation of the Regulation for Limiting Ozone Emissions From Indoor Air Cleaning Devices (Indoor ACD Regulation), as codified in the California Code of Regulations, title 17, section 94800 et seq. Trend Makers agreed to pay the full settlement amount on behalf of Tristar.
CARB staff conducted an investigation that revealed Tristar manufactured, sold, supplied, offered for sale, or introduced into commerce in the State of California indoor air cleaning devices that did not have the required CARB certification (Cal. Code Regs., tit. 17, § 94804). Tristar offered the uncertified indoor air cleaning devices for sale online; however, the website was missing the mandatory advisory required by California Code of Regulations, title 17, section 94806(e). Tristar also did not provide a true and accurate copy of the Indoor ACD Regulation to their known distributors, retailers, and sellers who supply, offer to sell, or sell the uncertified indoor air cleaning devices.
To settle the case, Trend Makers agreed to the penalty of $98,000 for total of forty-seven days of violation. Of the total settlement amount, $60,819 will be deposited into CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality. The remaining amount of $37,181 will fund the Supplemental Environmental Project (SEP) entitled Zero Emissions Farm and Garden Equipment. This SEP provides community outreach to Rancho Cordova, to replace the farm’s entire gas- and diesel-powered equipment and tool fleet with battery-powered electric alternatives. Tristar cooperated fully with CARB to resolve this matter. To come into compliance, Tristar is no longer offering the uncertified indoor air cleaning devices for sale in California.
