Pacific Ethanol Stockton LLC Settles For $60,000
In October 2023, the California Air Resources Board (CARB) reached a settlement with Pacific Ethanol Stockton LLC (Alto), with its principal location in Sacramento, California for the company’s violation of CARB’s Low Carbon Fuel Standard Regulation (LCFS Regulation), as specified in California Code of Regulations, title 17, section 95494 et seq.
During an onsite inspection, CARB staff discovered that Alto submitted quarterly fuel reports that deviated from the actual carbon intensity of the fuel reported. CARB documented violations as they related to the LCFS Regulation. To settle the case, Alto agreed to the penalty of approximately $4,615 for each of the thirteen (13) quarters, for a total penalty of $60,000.
Alto fully cooperated with CARB in the resolution of this matter and worked with its partners to retire 4,933 credits erroneously generated as a result of the company’s misreporting. Alto is now in compliance with CARB’s LCFS Regulation. The penalty amount will be deposited into CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality.
