Background
California State law requires that maximum penalties for violations of vehicular (AB 1685, Gomez, 2016) and non-vehicular (AB 617, Garcia, 2017) air pollution control laws and regulations be increased annually to reflect inflation, based on the California Consumer Price Index (California CPI) published by the California Department of Industrial Relations. To acknowledge the changes to State law, CARB’s Enforcement Policy refers to statute and requires documenting of California CPI changes and the resultant adjusted maximum penalties.
