Ituiutaba Bioenergia Ltda.Settles For $130,000
In December 2021, the California Air Resources Board (CARB) reached a settlement with Ituiutaba Bioenergia Ltda. (ITT), with its principal location in the City of Ituiutaba, Minas Gerais State, Brazil, in the amount of $130,000, for the company’s violation of CARB’s air quality regulations. The $130,000 will be deposited into CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality.
In discussions with CARB staff, it was revealed that ITT misrepresented the transportation method of fuel produced in Brazil and imported to California. Subsequently, ITT and agents thereof, submitted quarterly fuel reports that deviated from the actual carbon intensity of the fuel reported. CARB documented violations as they related to the Low Carbon Fuel Standards (LCFS) (Cal. Code Regs., tit. 17, § 95494 et seq.). To settle the case, ITT agreed to the penalty of $10,000 per LCFS violation for a total settlement of $130,000.
ITT has fully cooperated with CARB in this matter and has worked with its partners to retire 4,181 credits erroneously generated. ITT and its partners are now in compliance with the LCFS regulation.
