Kinder Morgan Products Pipelines Settles For $30,000
Kinder Morgan Products Pipelines (Kinder Morgan) paid $30,000 in penalties for violating the California Reformulated Gasoline Regulation as codified in California Code of Regulations (CCR), title 13, sections 2250-2273.5 et seq. (13 CCR §2250-2273.5).
Kinder Morgan voluntarily disclosed violation of the CaRFG Regulations to CARB. Subsequent investigations following the disclosure confirmed gasoline with ethanol content exceeding the allowable 10.0 percent by volume was supplied through 60 deliveries to 25 retail stations.
This settlement was reached in April 2019. Kinder Morgan agreed to pay a total of
$30,000 for 60 deliveries of non-compliant gasoline (per unit penalty of $500). Factors that influenced this penalty assessment included voluntary disclosure and full cooperation with CARB’s investigation.
Kinder Morgan took immediate actions to mitigate the incident and bring the fuel back into compliance.
