Coleman Powersports Settles For $16,425
On May 29, 2019, Coleman Powersports (Coleman PS), located in Tempe, Arizona, settled with the California Air Resources Board (CARB) for violations of the Small Off-Road Engines (SORE) and Off-Highway Recreational Vehicles (OHRV) regulations. During routine field inspections, CARB field staff identified, documented, and issued Notices of Violations for non-compliant SORE and OHRV units at Coleman PS California network retailers. One hundred fifty-six model year 2018 Coleman PS CK100-S Go-Karts and 36 model year 2018 Coleman PS K196 Go-Karts were affected and lacked an unconditional statement of compliance on the emissions label (Cal. Code Regs., tit. 13, §§ 2404; 2759.). Thirty-one model year 2019 Coleman PS CT200U Mini Bikes were affected and did not have a "C" or "3"(as indicated in Executive Order U-N-239-0001) in the eighth character of the Vehicle Identification Number (VIN). Coleman PS has agreed to assume responsibility for penalties assessed to its California network retailers, which is reflected in the number of affected units. The per unit penalties for Coleman PS in this case are $25 per unit for non-compliant emissions labels and $375 per unit for non-compliant VINs. Coleman PS agreed to pay its penalty and the penalty of its responsible California network retailers resulting in a total penalty amount of $16,425. Coleman PS has recalled many of the affected units from its California retailer network and is now in compliance with the California regulation.
