Staff Report
Public Hearing for Consideration of Amendments to the Rules and
Regulations of the Monterey Bay Unified Air Pollution Control
District

SUMMARY
This report proposes certain changes to the new source review
(NSR) rule adopted by the Monterey Bay Unified Air Pollution
Control District (APCD) on July 18, 1979. The staff believes
that these changes are necessary for the rule to satisfy the
requirments of state and federal law.
The staff is recommending the following changes to the District
NSR rule:
1. Lower the emission cutoff for the application of Best
Available Control Technology from 200 pounds per day to 150
pounds per day, and require that the Lowest Achievable
Emission Rate be achieved for sources with an increase of
200 or more pounds per day of any criteria pollutant of its
precursor.
2. Add language to clarify that precursors of any pollutant
subject to the rule are also subject to the rule.
3. Require that the Air Pollution Control Officer receive ARB
concurrence in granting innovative control technology
exemptions and in approving certain emission offsets,
including interpollutant tradeoffs.
4. Specify that any application which had not received a
preliminary decision by December 19, 1979, will be subject
to the new NSR rule.
5. Change the emission calculation procedure for modified
sources to reflect actual emissions from existing sources
rather than the maximum design capacity of the existing
sources.
6. Require a 2:1 offset ratio if emissions are computed on a
monthly average basis.
7. Revise the definition of modification to eliminate the
exemption from the provisions of Rule 207 for the use of an
alternate fuel where required by federal or state energy
policy.
8. Consider revising the definition of stationary sources to
make the rule consistent with other district rules.
RECOMMENDATIONS
In summary, the staff recommends that the Board amend the
Monterey NSR rule so that it conforms to the requirements of
state and federal law, and so that it is more consistent with NSR
rules in other districts. With the exception of the stationary
source definition, all of the changes recommended by the staff
are to restore the Monterey NSR rule to reflect the intent of the
rule as it was proposed by District staff.
