What is the waste and wastewater fleet option?

The waste and wastewater fleet option is available to fleets who voluntarily elect to comply with the alternative ZEV Milestones Option of the regulation. It allows certain waste and wastewater fleets to delay compliance of eligible vehicles by shifting them from Milestone Groups 1 and 2 into Group 3. What are eligible waste and wastewater fleet vehicles?

Eligible vehicles are existing natural gas vehicles owned or controlled by a waste or wastewater fleet as of January 1, 2024, and are fueled exclusively with biomethane.

Waste fleets may include eligible natural gas garbage vehicle configurations that are rear-loader, side-loader, and front-loader compactor trucks, garbage roll-off trucks and tractors exclusively used as waste transfer trucks. Other types of waste vehicles are not eligible.

Wastewater fleets may include eligible natural gas vehicles with a gross vehicle weight rating (GVWR) greater than 8,500 pounds that directly support the operation of facilities that collect, and process diverted instate organic waste to produce biomethane.

What is an eligible waste fleet?

An eligible waste fleet includes vehicles owned and operated by an entity that is contracted with a municipality that is mandated to support the hauling, transfer, and processing of diverted in-state organic waste to produce biomethane via franchise agreement or long-term contract, with either a minimum length of ten years or more, or with a minimum length of three years but includes a renewal provision when satisfying the contract terms.

A government agency “waste fleet” means the vehicles owned and operated by a city, county, public utility, special district, local agency or district, or a public agency of the State of California, and any department, division, public corporation, or public agency of the State of California involved in the collection, hauling, and/or processing of diverted in-state organic waste.

What is an eligible wastewater fleet?

An eligible wastewater fleet includes the vehicles owned and operated by a government agency or subdivision that owns and operates a wastewater treatment facility, and the agency’s primary purpose is the collection, treatment, and recycling of wastewater and biosolids.

How do I report my eligible waste and wastewater vehicles in TRUCRS?

To take advantage of the added flexibility of the Waste and Wastewater Fleet option, the fleet owner must do the following when reporting in TRUCRS. On the entity information page, select the ZEV Milestones Option compliance schedule and identify the fleet is a waste or wastewater fleet when prompted. On the vehicle information page, enter the vehicle information including the body type and fuel type. CARB staff will update the account to reflect the number of vehicles that are eligible for the additional time provided by the Waste and Wastewater extension.

What are the recordkeeping requirements for a fleet using the Waste and Wastewater Fleet Option?

Fleet owners must keep records that show their vehicles are fueled exclusively with biomethane and the fleet meets the eligibility requirements. Records include the following:

• A government agency waste fleet must keep a copy of the local ordinance, regulation, or code that requires the collection, hauling, and/or processing of diverted in-state organic waste.
• A waste fleet owner that is not a government agency must keep a copy of the franchise waste hauler agreement or another contract with a government agency implementing in-state organic waste diversion activities that has a minimum term length of ten years, or a minimum term length of three years but includes a renewal provision when satisfying the contract terms.
• A copy of the waste fleet’s internal database identifying which tractors are exclusively used as transfer trucks within the fleet.
• A copy of a permit or license to operate, or proof of ownership of a wastewater treatment facility.
• A copy of the vehicle registration identifying the wastewater fleet as the owner, or documentation showing the vehicle was purchased with an account indicating expenses incurred by the wastewater entity and were assigned to the wastewater fleet.
• Records of all biomethane fuel contracts in effect for affected vehicles as of January 1, 2024, and all fuel contracts that are executed on and after January 1, 2024.
