Specific details on seaport and intermodal railyard requirements can be found in the Advanced Clean Fleets Final Regulation Order, subsection 2014.1(a)(7). In the case of any discrepancy between this document and the regulation order, the regulation language applies.

Background

On April 28, 2023, the California Air Resources Board (CARB) approved for adoption the Advanced Clean Fleets Regulation (ACF), which establishes requirements for drayage trucks that transport cargo to and from California’s seaports and intermodal railyards. The ACF regulation also requires seaports and intermodal railyards to collect and report drayage activity at their facilities.

Applicable Definitions

• “Seaport authority” means an entity, either public or private, who is responsible for the operation of a seaport.
• “Marine or seaport terminals” means wharves, bulkheads, quays, piers, docks and other berthing locations and adjacent storage or adjacent areas and structures associated with the primary movement of cargo or goods from vessel to shore or shore to vessel, including structures which are devoted to receiving, handling, holding, consolidating, and loading or delivery of waterborne shipments or passengers, including areas devoted to the maintenance of the terminal or equipment. For the purposes of this article the term includes but is not limited to production or manufacturing areas, warehouses, storage facilities and private or public businesses or entities located on or surrounded by seaport property.
• "Railyard authority" means an entity, either public or private, who is responsible for the operation of an intermodal railyard.
• “Intermodal railyard” means a facility owned or operated by a Class 1 Railroad that receives both drayage trucks and locomotives.

What information must be collected and reported?

Seaport terminals and intermodal railyards with automatic reporting systems (e.g., Radio Frequency Identification Devices or Automatic License Plate Recognition) must collect the following information for each drayage truck that enters the facility or property:

1. Entry date;
2. Drayage truck’s license plate number and state of issuance; and
3. Drayage truck’s Vehicle Identification Number (VIN).

Seaport terminals and intermodal railyards that do not have automatic reporting systems must collect the following information for each drayage truck that enters the facility or property:

1. Drayage truck’s license plate number and state of issuance; and
2. Drayage truck’s VIN.

NOTE: If non-compliant drayage trucks are allowed access to the facility or property, more detailed information about the dispatching drayage motor carrier and drayage truck must be collected and reported as specified in subsection 2014.1(a)(7)(C).

When are the reporting deadlines for the above information?

The drayage truck information collected by seaport terminals and intermodal railyards must be reported to their respective seaport or railyard authority annually and no later than January 31 of the following calendar year. Seaport and railyard authorities must then report this information to CARB annually by March 1 of each year.

NOTE: If non-compliant drayage trucks are allowed access to the facility or property, the information required to be collected must be reported every three months according to the reporting schedules specified in subsections 2014.1(a)(7)(E) and 2014.1(a)(7)(G) of the ACF regulation.

Compliance Verification Process

CARB provides access to information about trucks reported for drayage that may be used by seaport terminals and railyards to verify compliance status. The lists are available via an online platform called Kiteworks. The main list is updated daily, and a second list is updated hourly throughout the day to reflect any changes. Both lists only contain the reported vehicle’s VIN, registration state, license plate number, and most recent date the vehicle information was updated.
