SB 1137 was signed into law by Governor Newsom in September of 2022, but implementation was put on hold due to a referendum that qualified for the November 2024 ballot. That referendum was withdrawn in late June of 2024[1] and the law went into immediate effect.
Under SB 1137, CARB responsibilities include:
- Develop regulations to set performance standards for the continuously operating emission detection system. The plans must identify chemical constituents to be monitored and detection targets
- CalGEM and CARB will review and either approve the leak detection and response plans or CalGEM will provide notice of deficiencies
- Work with CalGEM to develop methods for providing public access to the emissions data generated by operators
CARB staff are currently in the preliminary phase of the rulemaking process to develop performance standards.
